On January 2, President Obama signed into law the American Taxpayer Relief Act of 2012. This law prevents a schedule payment cut for physicians and other practitioners who treat Medicare patients from taking effect on January 1, 2013, among other things. Concerning MDS-related items, this bill extends therapy caps through January 31, 2013:
- $1,900 for physical therapy and speech pathology
- $1,900 for occupational therapy
In addition, section 603 extends the exception process for outpatient therapy caps through December 31, 2013. Providers of outpatient therapy services are required to submit the –KX modifier on their therapy claims, when an exception to the cap is requested for medically necessary services furnished through December 31, 2013.
