OIG updates LEIE database file: Why should LTC providers care?

An updated List of Excluded Individuals and Entities (LEIE) Database file has been released by the Department of Health and Human Services, Office of Inspector General (OIG), including all OIG exclusions and reinstatements made through July 2017.

Why do LTC providers need to know about this?

The OIG recommends long-term care providers check this list on a monthly basis to ensure excluded individuals are not working in their facilities, or otherwise face the potential risk for significant fines. Grounds for exclusion from Medicare funding were recently increased under a final rule published on January 12, 2017, to include individuals and entities convicted of interfering with or obstructing audits. Prior to this final rule, exclusion authority was limited to those convicted of obstructing criminal investigations.

It is also important for providers to note that the agency clarifies the definition of “audit” to include the survey and certification process.
